Law and regulation

In the Office of the Third Sector we are responsible for:

• charity law in England and Wales, making sure that the legal framework helps charities to develop their activities and services and to play an increasing role for good in society while giving confidence to the public about the integrity of charities

• cutting red tape for third sector organisations, by monitoring new legislation and encouraging changes to existing legislation and good regulatory practice to ensure that the regulation of these organisations is fair and proportionate

More general information about regulation that can affect third sector organisations, such as employment and health and safety law, can be found at Businesslink

Making it easier for charities to sell and make other disposals of land

We are consulting on extending the definition of “qualified surveyor” in section 36(4) of the Charities Act 1993

Currently, trustees of English and Welsh charities who want to sell or otherwise dispose of land must normally get a written report from a professional adviser who is a “qualified surveyor” as defined by the Charities Act 1993.  This definition may be too narrow and we are consulting about extending it to include Fellows of the National Association of Estate Agents.
