General Block Exemption Notification Procedure


Procedure for General Block Exemption and SANI Completing Summary Information Form on SANI

For State Aid measures which satisfy your objective(s) under the general block exemption regulation the Member State is required to send to the Commission, summary information sheet about the aid measure via the State Aid Notification Interactive (SANI) within 20 working days following the implementation of the measure.

You need to ask yourself three questions...

1.Is the activity within the scope of the State Aid rules - is it economic?
2. Does the aid meet all four tests for State Aid?
3. Is the aid covered by the general block exemption regulation?

If the answer to those questions is yes, then you need to complete the general block exemption summary information sheet.

Completing Summary Information Sheet on SANI

The Commission expects all Member States to submit general block exemption summary information sheet via SANI.

To be registered on SANI please contact the State Aid branch. For help using SANI please consult the SANI manual.

Aid administrators have to ensure compliance with all of the conditions of the general block exemption regulation. Please seek the advice of State Aid Branch if you have any doubts about the compliance of your scheme with the State Aid rules. Please note that these requirements include provision of accurate and timely information on the usage of the scheme as required, in particular for the annual return.

The general block exemption contains detailed guidelines and conditions. Before completing the Information Sheet, consider in particular the sections in the Regulation relating to Definitions, Eligible Costs, Maximum Aid amounts and Scope (i.e. sectors or areas that can or cannot be supported).

For Legal Basis, enter details of the Act that allows the spending body to act or spend in the way proposed (e.g. Regional Development Agencies Act 1998). Please ensure that the legal document gives a clear statement of the conditions of use of that particular scheme.

You will need to provide a web site link to the scheme. The web site linked should provide full details of the scheme including the criteria for qualifying for aid, eligible costs, scope etc. This is to fulfil the requirement that Member State have to publish on a web site full details of the scheme. The link to the web site must be given on the SANI submission otherwise the summary information sheet cannot be submitted.

Once completed, please send the electronic summary information sheet via SANI to State Aid Branch who will send it to the Commission for submission.
