Legislation


The Energy Using Products Directive 2005/32/EC (EuP) came into force on 10 August 2005 was replaced by the Energy Related Products Directive 2009/125/EC (ERP) on 20 November 2009.

The Directive was originally transposed into UK law under statutory instrument SI 2007 No. 2037, amended by SI 2009 No. 2560 and repealed by SI 2010 No. 2617.

The Directive provides a framework for establishing minimum eco design requirements for energy using and energy related products.

Implementing measures have been established (and more will be added) in the form of regulations by the European Commission (EC) for specific product groups.

The European Commission has developed the Blue Guide which is intended to contribute to better understanding of Directives based on the New Approach and the Global Approach, and to their more uniform and coherent application across different sectors and throughout the Single Market.


Glossary

Directive – A directive is a legislative act of the European Union, which requires member states to achieve a particular result without dictating the means of achieving that result.

Regulation – A regulation is a legislative act of the European Union that becomes immediately enforceable in law in all member states simultaneously.

Statutory Instrument - A Statutory Instrument (SI) is the principal form in which delegated or secondary legislation is made in Great Britain.

Repeal - To revoke or rescind, especially by an official or formal act.

Recast - To set down or present in a new or different arrangement.

Commission Decision – A decision is one of the three binding instruments provided by secondary EU legislation. A decision is binding on the person or entity to which it is addressed which may be a member state.

Corrigendum - An error to be corrected especially a printer's error.
