Civil sanctions and recovery of testing costs - Ecodesign for Energy Related Products Regulations (SI 2010 No. 2617)
Under regulation 13 of the Ecodesign for Energy-Related Products Regulations 2010 (SI 2010 No. 2617) which came into force on 20 November 2010, NMO as the appointed UK market surveillance authority have the power to impose civil sanctions and to recover testing costs.
A requirement of the Regulations is to publish guidance on the use of civil sanctions and the recovery of testing costs (PDF, 542 Kb) .
The published guidance also contains an enforcement undertaking form (PDF, 195 Kb) which can be downloaded seperately.
Prior to publication, the NMO held a consultation exercise which was designed to invite views on NMO's draft guidance. This was not a formal consultation on the legal presentation and drafting of the sanctions but was designed to elicit views on their practical implementation and the procedures associated with their use.

The consultation opened on 14 February 2011 and closed on 14 March 2011.
