Guidance on Transport Controls

Amendment of UK Trade Controls to include Transport Related Activities

In 2004 the UK introduced new controls on the trading, commonly referred to as “Trafficking and Brokering”, of certain goods. These controls were reviewed 3 years after they came in to effect. As a result of the Review of Export Control Legislation 2007, the Government decided to implement a number of changes. These include restructuring the trade controls into three categories (A, B, and C) and bringing within the controls certain transport related activities.

These changes are being phased in through 3 tranches. The third tranche, which will come in to effect on 6 April 2009, introduces a number of amendments, including extending the controls to transport related activities undertaken within the UK or by UK persons overseas, so that they are subject to the level of control applicable to the category of goods being moved.

This guidance is intended to assist those individuals and companies who are or may become involved in arranging or providing transport for Category ‘A’, ‘B’ or ‘C’ goods to understand the controls and determine when a licence will be required.

IMPORTANT – The guidance referred to above relates to legislation which comes in to effect on 6th April 2009 and has been made available to enable individuals and companies to become familiar with the new controls. However, if you are or may become involved in trade activity between now and 6th April, you should refer to existing guidance on the website which explains the changes to the trade controls which came in to effect on 1 October 2008. Once the new controls come in to effect, the new guidance will replace the existing guidance which will be removed from the website.
