Orders made under the Export Control Act

The Export Control Act 2002 includes provision for the implementation of Statutory Instruments or Orders which specify the details and requirements of the legislation. These Orders are subject to amendment and review.

The Act originally resulted in 4 Orders. Following the Review of Export Control Legislation 2007, a new consolidating order was introduced.

 

Current Legislation

NOTE: Amendments have made to each of the original orders in the form of small changes to articles and amendments to the control list.

Orders  

  • Export Control Order 2008

This is the main legislation which controls:

  • the export of strategic goods, the transfer of technology and the provision of technical assistance.
  • trade in goods. This encompasses not only actual physical exports from the UK but also applies to trade in military equipment between overseas countries where any part of the activity takes place in the UK. (NOTE that more stringent rules apply to certain categories of goods).
  • trade with destinations under non-binding sanctions and embargoes introduced by the United Nations (UN), the European Union (EU) and the Organisation for Security and Cooperation in Europe (OSCE) and implemented in the UK.

This Order came into force on 6 April 2009 and revokes the previous Orders including:

  • Export of Goods,Transfer of Technology and Provision of Technical Assistance (Control) Order 2003 
  • Trade in Goods (Control) Order 2003 
  • Trade in Controlled Goods to Embargoed Destinations Order 2004

  • Export of Radioactive Sources (Control) Order 2006

This legislation controls the exports of certain high-activity radioactive sources as defined under the International Atomic Energy Agency Code of Conduct on the Safety and Security of Radioactive Sources. See Controls on Radioactive Sources.

 

Background

Regulatory Impact Assessments (RIAs) must be completed for all UK policy changes, which could affect the public or private sectors, charities, the voluntary sector or small businesses.

As part the Export Control Legislative Review conducted in 2007-8 and implementation of changes and extension of controls, impact assessments were carried out. These are accessible under the Review of Export Control Legislation 2007.
