1. The European Union has adopted a further Regulation amending Council Regulation (EC) No.329/2007 concerning restrictive measures against the Democratic People’s Republic of Korea (DPRK). Details as follows:

The amending Regulation extends the prohibition on the supply, sale or transfer of certain items, materials, equipment, goods and technology which could contribute to DPRK’s nuclear-related, other weapons of mass destruction-related or ballistic missile related programmes. The relevant provisions have been extended to all dual-use items listed in Annex I to the Dual-Use Regulation (Council Regulation (EC) No.428/2009) and also to other sensitive items listed in new Annex 1a to the amending Regulation. It also imposes new restrictions on obtaining technical and financial assistance from North Korea.
3. The amending Regulation was adopted on 22 December 2009 and entered into force on 23 December 2009.
4. In addition, UK implementing legislation, the Export Control (North Korea) Order 2007 (“the 2007 Order”), has been amended by updating references made in the 2007 Order to the Regulation as amended by the amending Regulation. The opportunity has also been taken to provide that, where a person would be guilty of any offences which may overlap with those in the North Korea (United Nations) Sanctions Order 2009 (“the UN Order”), he would be guilty only of those in the UN Order.
