First company suspension for continued non-compliance with Open General Licence requirements

NOTICES TO EXPORTERS - 2009/04 - 13 March 2009

Notice to exporters 2008/12 gave details of the procedure ECO introduced in May 2008 to address instances of non-compliance with the terms and conditions of Open General and Open Individual licences found at Compliance visits.

Since that time, 38 warning letters have been sent out to company directors or equivalent, explaining what issues need to be put right and how the company might address these issues before the next visit.

Most of the revisits have found a marked improvement.

However one company has not made sufficient improvement to its procedures and therefore the first letter suspending a company’s use of OGELs for a period of 3 months was issued on 13 March 2009. Another company has had its OIEL revoked in similar circumstances.

Suspension does not prevent a company applying for SIELs to export, but end-user undertakings must be supplied with the application and you are reminded our target time for processing SIELs is 20 working days.

ECO takes non-compliance with export controls very seriously. You should make sure you read and understand all the terms and conditions of the licences you are using and are able to supply documentation which shows you have complied with those terms and conditions at the time of a compliance visit.
