Changes to the Export Control Legislation

NOTICES TO EXPORTERS - 2008/25 - 17 December 2008

Amendment to the Export of Goods, Transfer of Technology and Provision of Technical Assistance (Control) Order 2003 ("The Main Order")

 

  1. The Department for Business, Enterprise and Regulatory Reform has made amendments to the 2003 Order. The relevant amendments appear in:

    The Export of Goods, Transfer of Technology and Provision of Technical Assistance (Control)(Amendment No. 2) Order 2008 (S.I. 2008 No. 3161) ("the amending Order")

    The amending Order will come into force on 2nd January 2009.

 

  1. The amending Order makes a number of changes to Schedule 1 and Schedule 5 to the Main Order. These are as a consequence of the latest review of the Wassenaar Arrangement (WA), as well as some national policy changes. The principal changes are:

    In Schedule 1:

    Changes in the following categories:

 

  • ML1
 - additional text in paragraph g of the Note;
  • ML2
 - new Note 2;
  • PL5035
 - new control entry bringing under national control components that are both specially designed to provide ballistic protection and specially designed or modified for vehicles specified in ML6.b.;
  • ML7
 - changes to ML7.e; ML7.f; and ML7.g.;
  • ML17
 - new Technical Note to ML17.e.3;
  • ML21.b.4
 - additional text;
  • PL8001
 - excluding new Regulation entries 1A006 and 1A007

 

  1. The amending Order also clarifies that reference to Schedule 1 in the Trade in Goods (Control) Order 2003 and the Trade in Controlled Goods (Embargoed Destinations) Order 2004 are references to that Schedule as amended and updates the 2003 Order so it refers to the most recent amendments to Council Regulation (EC) No. 1334/2000. (See Notice 2008/23)

  2. The UK Strategic Export Control Lists (both the Consolidated and UK Military List versions) will be amended early in 2009 to reflect these changes.
