Amendments to the Trade in Goods (Control) Order 2003 ("The Trade Order") and the Trade in Controlled Goods (Embargoed Destinations) Order 2004 ("The Embargoed Destinations Order")

NOTICES TO EXPORTERS - 2008/15 - 9 JULY 2008

  1. The Department for Business, Enterprise and Regulatory Reform has made amendments to the Trade Order and the Embargoed Destinations Order. The relevant amendments appear in:
The amending Order will come into force on 1st October 2008.
  1. The amending Order makes a number of changes to the Trade Order and the Embargoed Destinations Order.

  2. The principal change introduced by the Order is a three tiered structure to trade controls to respond to recent concerns relating to specific goods and activities. Until now, trade controls followed a two tier approach. The core changes are:

    • Category “A”, “B” and “C” Goods replace “controlled” and “restricted” goods.
    • Fully extra-territorial controls (i.e. controls applying to UK persons anywhere in the world) on certain trading activities will now apply to small arms and man-portable air defence systems (MANPADs) under Category B
    • The strictest controls under Category A, which cover both extra-territorial, trading and the full range of supporting activities, will be extended to cover cluster munitions.
  3. Other amendments include correcting a current legal anomaly in the current trade controls on the treatment of non-military explosive goods. This will bring a wider range of activities relating to the trading of those goods to embargoed destinations under control.
