Guidance on the Gas Act 1965, under which licensed Gas Transporters proposing to store gas in natural porous strata onshore seek consent from the Secretary of State for Trade and Industry: A consultation

This consultation ran from 23 May 2007 to 15 August 2007.

The Government has committed to simplifying and streamlining the onshore gas infrastructure consents regime in light of the UK's increasing gas import dependence and our need therefore for additional gas supply infrastructure.

Proposals for a new consenting regime for all major infrastructure, including major energy projects, are set out in the Government's White Paper, Planning for a Sustainable Future, published on 21 May 2007.

In advance of any future changes that may be made to the planning system, it is important that existing legislation under which applications may be made to construct new gas supply infrastructure, are properly understood.

The Gas Act 1965 is the applicable consenting route for licensed gas transporters who wish to store gas in natural porous strata (i.e. partially depleted oil and gas fields or aquifers) onshore. No guidance on it has been produced before, but in light of increased interest in the use of the Gas Act, it is important that both those making applications, and consultees or other interested parties understand the processes of the legislation.

This consultation seeks views on whether the guidance explains the processes, requirements, timescales and other information relating to the Gas Act 1965 in a sufficiently clear and comprehensible manner to meet the needs of industry, interested and representative bodies and individuals. It is intended that final guidance will be published in due course.
