Since 6 April 2008, several national regulators as well as all the local authorities in England have been under a statutory duty to have regard to Better Regulation principles and the Compliance Code when they carry out specified regulatory functions. The aim is to embed a risk-based, proportionate and targeted approach to regulatory inspection and enforcement among regulators.
To spread benefits of the Code and the Principles more widely the Government has extended their coverage to additional regulators with relevant regulatory functions. In addition to those previously covered, the Code and Principles will apply to:

The draft statutory instrument extending the coverage of the Code was approved by Parliament in October 2009 and came into force in November of that year.
The Better Regulation Executive invited views on this proposal from regulators likely to be affected by the proposed extension, as well the views of businesses, third sector organisations and other interested parties. The consultation closed on 13 February 2009 and the Government published its response on 29 May 2009. The consultation document and the Government response are available below:
