Dear Sir
ELECTRICITY ACT 1989 (SECTION 37 AND SCHEDULE 8)
TOWN AND COUNTRY PLANNING ACT 1990 (SECTION 90)
APPLICATION BY NATIONAL GRID FOR CONSENT TO INSTALL AND KEEP INSTALLED A NEW SECTION OF 275KV ELECTRICAL LINE ABOVE GROUND EAST OF BRAMHAM SUBSTATION IN THE DISTRICT OF LEEDS AND SELBY
I refer to the above application.
This letter comprises the relevant notice under Rule 4(1) of the Electricity Generating Stations and Overhead Lines (Inquiries Procedure) (England and Wales) Rules 2007 that a public inquiry will be held onto the above application and that there will be a pre-inquiry meeting, the date of which will be notified to the parties in due course.
The Secretary of State has appointed a Planning Inspector from the Planning Inspectorate and Engineering Inspector from the Department acting in an independent capacity to conduct the inquiry and jointly report to him on the application.
Notice is hereby given in accordance with Rule 4(1) of the Electricity Generating Stations and Overhead Lines (Inquiries Procedure) (England and Wales) Rules 2007 that the following matters are, in the Secretary of State’s view, the matters to be considered at the inquiry:
1. The extent to which the National Grid’s proposal including the works necessary for the proposed upgrading for the reinforcement of the PHG line (“the proposed development”) and the alternatives proposed by the affected landowner (“the alternatives”) would be in accordance with the relevant development plan(s) for the area.
2. The relative merits of the proposed development and the alternatives in addressing the requirement to reinforce the Ferrybridge ring and to ensure security of supply.
3. The relative merits of the proposed development and the alternatives in terms of:
a. their impact on the Green Belt;
b. their landscape and visual impact; and
c. their ecological impact (in particular on great crested newts) having regard to the requirements of the Habitats Regulations (SI 1994/2716).
4. Any other matters that the Inspectors consider relevant
It should be noted that whilst the above matters appear to the Secretary of State, from the evidence so far available to him, to be the principal ones that need to be addressed, this statement does not preclude the inquiry Inspectors from hearing evidence on any other matters that they may consider to be relevant to consideration of the application. Neither does this statement pre-determine the order in which issues are to be addressed at the inquiry or imply any particular order of importance.
Notice is also given that the Secretary of State, using the power in Section 61 of the Electricity Act 1989, has decided that the hearing into the related applications under paragraphs 6 to Schedule 4 to the Electricity Act 1989 for necessary wayleaves over land at Toulston, Tadcaster, Yorkshire should be held concurrently with the public inquiry into the section 37 application, and considered by the same Inspectors, who will then report on the wayleave application as well.
Yours faithfully
RICHARD MELLISH
