Why are you not commencing all the provisions relating to company Secretaries at the same time

The provisions being brought into force in April will enable private companies to choose not to have a secretary. This is a significant deregulation. It removes a burden on every private company that does not consider it needs a secretary. In practice, many are expected to continue to have a secretary as there is no reduction in the tasks undertaken by secretaries.

The provisions relating to registers of secretaries will come into force along with the similar provisions for directors, in October 2009. It is also necessary to keep the existing rules for when a company does not have a secretary available.
