OGEL (Export after Repair/Replacement under Warranty: Military Goods)

Decide, and if appropriate, use this open general licence (OGL), which allows the export of specified controlled items by any exporter. Use of this OGL removes the need to apply for a Standard Individual Licence (SIEL). However, exporters must ensure all conditions are met and shipment and destinations are eligible. Exporters will be subject to regular Compliance visits.

Specific Conditions

This OGEL allows, subject to certain conditions, the export of military goods which have been imported into the UK for repair or replacement under warranty. These goods need to be re-exported or returned to one of the following:
-   the government of the country which sent the goods to the UK
-   the NATO  Maintenance and Supply Agency, or
-   any other person who the goods were exported to.

However, this replacement, or these repairs, will have to take place within five years of the date they were originally exported.

The current licence is 11th June 2008 dated and enters into force on 20th June 2008. All previous licences are now revoked.

Note: You will need to state the exact name of the licence in full on any supporting documentation given to Her Majesty's Revenue and Customs (HMRC)

If the goods are classified, you are likely to require F680 clearance if you are planning to use this OGEL.

Using this Licence

You will need to register to use this licence on SPIRE.

It is your responsibility as the exporter :

  • to use this licence within all its defined terms and conditions.
  • to keep updated of any licence amendments. (eg changes to permitted or excluded destinations or goods)
