Estate Agents Act - Outcome of Recent Appeals

Estate Agents Act 1979

Appeals to the Secretary of State from decisions of the Office of Fair Trading (“the OFT”)

The Secretary of State for Business, Enterprise & Regulatory Reform received appeals from Quay Homes Estate Agency Limited, Lucy Lloyd and Carlo Ykhlef (“the appellants”), all of Quay Road, Bridlington, East Yorkshire, from decisions of the Office of Fair Trading to issue prohibition orders to the appellants under the Estate Agents Act 1979. A public hearing of the appeals was held in Doncaster on 5 February 2008; the hearing was adjourned to 12 February 2008 when it was concluded. The hearing was before a panel of persons appointed by the Secretary of State to hear the appeals on his behalf. Notice is now given that, on 13 March 2008, the Secretary of State, having considered the panel’s report and accepted its recommendations, dismissed the appellants’ appeals.
