The new provisions contained in Part 31 of the Companies Act 2006 on Dissolution and Restoration to the register will come into effect from 1 October 2009.

Yes. To enable ex-employees or their estates to receive compensation for personal injury or fatal accident from companies dissolved prior to 16 November 1969 (11 March 1971for Northern Ireland) or their insurers, which they are currently unable to obtain, the Government has decided to remove the current bar on restoring those companies to the register from 1 October 2008.
The repeal of the current bar is contained in Article 2(f) of The Companies Act 2006 (Commencement No. 7, Transitional Provisions and Savings) Order 2008. A copy of the Order can be found at the Regulations made page.

If an application for restoration to the register is made on or after 1st October 2008, the application will not be refused on the grounds that the company was dissolved prior to 16 November 1969 (11 March 1971 in Northern Ireland).

The 2006 Act does not restate the bar on restoration of companies dissolved prior to 1969 (or 1971 in Northern Ireland). Its repeal on 1 October 2008 abolishes it for good and it will continue to be abolished on and after 1 October 2009.
