Regulators' Compliance Code - extension of Compliance Code's coverage
Since 6 April 2008, several national regulators as well as all the local authorities in England have been under a statutory duty to have regard to Better Regulation principles and the Compliance Code when they carry out specified regulatory functions. The aim is to embed a risk-based, proportionate and targeted approach to regulatory inspection and enforcement among regulators.
To spread the benefits of the Code and the Principles more widely the Government has extended their coverage to additional regulators with relevant regulatory functions. In addition to the those previously covered, the Code and Principles will apply to:
- specified regulatory functions of Local Authorities in Scotland, Northern Ireland and Wales
- specific business-facing functions of public sector regulators in England
- functions of other relevant national regulators currently omitted from the coverage of the Code and the Principles
The Statutory Instruments specifying the regulatory functions to which the Compliance Code and the Principles of Good Regulation apply can be found in the links below:

Future amendments to the Listing Order
Please note that as indicated in paragraphs 5.6 and 5.7 of the Consultation Document (see link above), future amendments to the Listing Order are the responsibility of departments and not BIS. This means that when departments introduce any new regulatory function that should be covered by the Compliance Code or amend any of the legislation in the Schedule to the Order because it is out of date, they should update the Listing Order themselves. From a better regulation point of view, departments should ensure that new functions and new bits of legislation which ought to be added to the Listing Order are added to it.
